Identification of Learning Disabilities

Throughout our posts we have witnessed lively debates surrounding the renewal of IDEA in 2003 concerning the rapid growth of U. S. special education learning disability enrollments. Clearly, Congress agreed to try to curtail LD over-identification in the enactment of IDEA 2004. Subsequent regulations issued by the U. S. Department of Education highlighted regulatory changes to IDEA 1997 addressing the issue. An overview — “Identification of Specific Learning Disabilities” — has been published (Education Legacy) to go with related regulations. It represents one of the “high interest topics” of 2006, addressing …”significant changes from preexisting regulations to the final regulatory requirements regarding the identification of specific learning disabilities.”

The new regulations provide us with a skeleton framework for seeing how changes can be made at the level of the local school district (LEA).
